New Zoning Rules Could Boost Small Business Flexibility

The Long Range Planning Subcommittee of the Planning Commission is set to review a proposed Zone Text Amendment (ZTA) designed to support small businesses by expanding options for Accessory Business Uses (ABUs) and Ancillary Business Activities. The initiative aligns with the City’s Small Business Initiative, which aims to cultivate a diverse and vibrant local economy.

Background

In response to a 2020 City Council directive, staff partnered with the West Hollywood Chamber of Commerce to identify strategies to attract and sustain small businesses. Challenges like high rents, limited space, and evolving consumer trends—exacerbated by the COVID-19 pandemic—have made adaptability critical for small business survival.

The proposed ZTA seeks to address these challenges by offering small businesses more opportunities to diversify their services and revenue streams while minimizing regulatory hurdles.

Key Features of the Proposed Changes

The amendment focuses on revising West Hollywood Municipal Code (WHMC) Section 19.36.030. Key updates include:

  • Enhanced Flexibility: ABUs can now have separate entrances and external visibility, complementing the primary use of a business.
  • Increased Space Allocation: ABUs may occupy up to 50% of a business’s total floor area, compared to the current limit of 25%.
  • Streamlined Permitting: Clear permit requirements for ABUs will make it easier for businesses to adapt without extensive zoning changes.
  • Clarified Definitions: The amendment renames “Incidental Activities” as “Ancillary Business Activities” to distinguish them from ABUs.
Allowed Activities

To foster innovation and attract foot traffic, the proposal allows a variety of ancillary activities, such as:

  • Live DJs
  • Food, beverage, or wine tastings in retail spaces.
  • Craft workshops, painting, cooking, or similar activities in cafes, restaurants or retail spaces.
  • Co-working spaces or designated remote working areas that could include workstations, meeting rooms, and Wi-Fi access within cafes or restaurants
  • Community indoor markets featuring local farmers, artisans, and small businesses within retail spaces
  • Live podcast recording studios within cafes, restaurants, or bars, allowing audience participation where customers can interact with hosts and guests
  • Small theater rooms within cafes, restaurants, or retail spaces for film screenings and discussions
Prohibited Uses

The ZTA excludes activities like live amplified music and dancing to maintain a balance between business operations and community impact.
