
A major change went into effect this week at U.S. ports of entry, and as you might imagine, it’s raising concern in West Hollywood’s trans and non-binary communities.
New Customs Border Protection guidance now directs airlines to indicate only male or female (“M” or “F”) in what’s known as the Advance Passenger Information System (APIS), which tracks international travelers even if a passport shows “X” as the gender marker.
The “X” marker has been a lifeline for many in the trans and non-binary communities since it became available in 2022. It allows people to travel with documents that reflect who they are, without being forced into a binary category that doesn’t fit.
It’s not even clear how the government plans to enforce the new policy, but confusion and frustration are running high. What happens when someone’s passport says “X” but the airline submits “M” or “F”? Could airlines block travelers from boarding (costing them money) or subject them to additional, humiliating screening?
Even though courts have continued to block Trump from banning a third gender marker altogether, this week’s rule can still make life more difficult and stressful for trans and non-binary travelers, especially as the holiday travel season begins.
The rule does affect anyone applying to or renewing membership in the Trusted Traveler Programs, which now require applicants to choose one of the two approved binary designations (male or female) to complete their application.
To be clear: land border crossings and domestic flights are not affected by the change.
CBP insists that valid travel documents remain valid. In a statement the agency said: “All valid U.S. travel documents are being processed as they were previously. … An applicant’s choice of sex is not criteria for an applicant’s admission into the U.S.”
For now, the best advice for trans and non-binary residents is simple: make sure your passport is current, check each airline’s policy before booking, and most important – know your rights and stand your ground if questioned or harassed.
