The Council will receive an update on programs to market and promote the business community on the City’s Eastside, as well as outreach to entertainment studios. Staff recommends: hiring a communications and marketing firm to promote the Eastside (approximately $90,000); implementing an Eastside Business Neighborhood Watch program (approximately $5,000); hiring an event producer to organize a car show celebrating the centennial anniversary of Route 66 (approximately $29,000); and hiring a firm to assist with filling vacant commercial spaces ($60,000). The City Council will consider adopting a policy establishing procedures for responding to disruptions in telephonic or internet service that prevent members of the public from participating remotely in City Council meetings, consistent with Brown Act requirements as amended by Senate Bill 707. The City Council will consider approving the sponsorship of a community town hall forum with Los Angeles County District Attorney Nathan Hochman’s Office and the Los Angeles District Attorney LGBTQ+ Advisory Board, focusing on issues impacting the LGBTQ+ community. If a California public official has a legally disqualifying conflict of interest, recusal is not optional—it’s required by law.
The key law is California Government Code § 87100, part of the Political Reform Act. It states that a public official “shall not make, participate in making, or in any way attempt to use” their official position to influence a governmental decision in which they have a disqualifying financial interest.
I would point out that the only person who spoke out against the TODAP was the paid lobbyist from Abundant Housing who does not appear to live in West Hollywood. Abundant Housing is part of the “housing” groups who are under the umbrella of “Welcoming Neighbors Network”, a D.C. based non-profit lobbying group that has hired Chelsea Byers as an advocate.
The facts appear sufficiently similar to recent FPPC guidance that an independent FPPC opinion should be requested. Until that question is resolved, Councilmember Byers should voluntarily recuse herself from these matters to preserve public confidence in the integrity of the City’s decisions.
The first issue that needs to be addressed at Monday’s Council Meeting is the fact that Chelsea Byers needs to recuse herself from voting on any SB 79, TODAP or housing issues. An article revealed today that Byers is a paid Policy Manager for Welcoming Neighbors Network, an organization behind SB 79, Byers is paid by the lobby behind this agenda and must step aside from these votes.
